It’s common for policy holders to have ONE year from the date of damage to file a claim. The Texas Windstorm Insurance Association (TWIA) is one example of that one-year limit. Not all policies are the same, though, so be sure to check yours or ask your agent.

The insurance company must keep time frames to serve its policy holders responsibly and legally.

Fifteen

Your insurance company must tell you it received your claim within 15 days, according to Texas law. Be sure the insurer knows how to contact you. That may seem obvious, but you would be surprised how often people get a new phone number or email address and forget to notify their insurance company.

When you get the acknowledgment, the company may ask you for additional information such as a proof of loss form. Provide as much information as you can as soon as you can to help the claim process go smoothly. As soon as it has the information it needs, the insurance company has 15 business days to accept or deny your claim. If it is denied, the company must tell you why in writing.

If the company has agreed to pay the claim, it has FIVE business days to send you the check.

If you need help negotiating your claim, you can pay for the services of a public insurance adjuster. Public adjusters don’t work on behalf of insurance companies; they work for you. Keep in mind, they are not allowed to give legal advice and must have a Texas Department of Insurance (TDI) license.
